A Mitchell police officer has been cleared in an officer-involved shooting in that city a month ago.

Attorney General Marty Jackley says the investigation by the State Division of Criminal Investigation found that Mitchell Police Sergeant David Beintema was justified when he shot 52-year-old Joy Ann Sherman on November 8.

Mitchell Police had been called around 5pm that day to a hotel where a woman was reported to be intoxicated and threatening to hurt herself and others with a gun.

The officer fired at Sherman when the situation escalated, and she died two days later at a Sioux Falls hospital.
